2. Applicability

These terms of service apply to all offers, orders, agreements and deliveries of products through the Ideal AirGroep webshop.

By placing an order, you agree to these terms.

Deviations from these terms are only valid if agreed upon in writing.

3. Offers and prices

  • All offers are non-binding, unless expressly stated otherwise.

  • Prices in the webshop include VAT and any statutory levies.

  • Obvious errors or mistakes in the offer do not bind Ideal AirGroep.

  • Delivery times are indicative and not a strict deadline.

4. Payment

  • Payment is made in full during the ordering process in the webshop.

  • Orders are only processed after successful payment.

  • In case of late payment, Ideal AirGroep reserves the right to suspend or dissolve the agreement.

  • Any collection costs will be calculated in accordance with the Decree on compensation for extrajudicial collection costs.

5. Delivery

  • Delivery takes place at the address specified by the customer.

  • The specified delivery times are indicative.

  • Ideal AirGroep may deliver orders in parts.

  • Any delivery costs will be clearly stated in advance.

  • The risk of damage or loss passes to the consumer upon receipt of the product.

If delivery is not possible due to incorrect address details or failure to accept delivery, extra costs may be charged.

6. Right of withdrawal (14-day cooling-off period)

Consumers have the right to dissolve the agreement within 14 days of receiving the full order without stating reasons.

Conditions:

  • The product must be unused and undamaged.

  • The product must – if reasonably possible – be returned in its original packaging.

  • Return instructions must be followed.

Exclusions:

  • Custom-made products.

  • Products with a limited shelf life.

  • Products that cannot be returned for hygienic reasons if the seal has been broken.

After correct receipt of the return, the purchase amount will be refunded within the statutory period.

7. Complaints and claims

We request you to check the product immediately upon receipt.

Complaints about:

  • Damage

  • Shortages

  • Incorrect delivery

must be reported in writing within 10 working days of delivery.

In case of a justified complaint, Ideal AirGroep will:

  • Repair the product, or

  • Deliver a replacement product, or

  • Provide a (partial) refund.

Complaints about one product do not give the right to dissolve the entire agreement.

8. Warranty

Ideal AirGroep grants a two-year warranty on products, unless stated otherwise.

The warranty does not apply if:

  • The product has been used improperly.

  • Changes have been made without permission.

  • The product has been used for a purpose other than that for which it is intended.

If the product has been manufactured by a third party, the manufacturer's warranty of that producer applies.

9. Liability

Ideal AirGroep's liability is limited to the amount paid out by the liability insurance, plus the deductible.

This limitation does not apply in case of:

  • Intent

  • Wilful recklessness

Ideal AirGroep is not liable for indirect damage, unless otherwise determined by law.

10. Retention of title

All delivered products remain the property of Ideal AirGroep until full payment has been made.

11. Force majeure

Ideal AirGroep is not liable for delay or damage caused by circumstances beyond its control, such as:

  • Government measures

  • Transport problems

  • Power outages

  • Fire

  • War or calamities

  • Problems with suppliers

If force majeure lasts longer than 30 days, both parties have the right to dissolve the agreement.

12. Intellectual property

All intellectual property rights relating to products, designs, images, texts and other materials belong to Ideal AirGroep.

These may not be copied, distributed or used commercially without written permission.

13. Changes

Ideal AirGroep reserves the right to change these terms of service.

Customers will be informed of any significant changes.

14. Applicable law

All agreements are exclusively governed by Dutch law.

Disputes will be submitted to the competent court in the district where Ideal AirGroep is located, unless mandatory law dictates otherwise.

The Vienna Sales Convention is excluded.
